How to apply

To apply for NSW nomination for a business migration visa, you should follow the process below:

  • Submit an Expression of Interest (EOI) in SkillSelect (188 and 132 visas only)
  • Complete the relevant NSW nomination application form
  • Pay the application fee (online payment is available)
  • Submit your complete application to NSW Department of Industry. If you are nominated by NSW, apply for the visa to the Department of Immigration and Border Protection (DIBP)

1. Submitting an EOI

This step applies to you if you are applying for NSW nomination for the following visas:

  • Business Innovation and Investment (Provisional) visa (subclass 188)
  • Business Talent (Permanent) visa (subclass 132).

Before applying for NSW nomination, you need to first submit an Express of Interest (EOI) in SkillSelect, DIBP's online registration system. Read more about SkillSelect.

After submitting an EOI, you will be allocated a unique EOI number, which you should provide in your NSW nomination application.

2. Completing the application form

The table below sets out the appropriate forms required for each visa subclass.

Supporting documents with your application

You should include evidence to support the information that you submit in your application. The document checklist in the relevant application form provides a useful guide.

All supporting documents must be certified copies. Please do not send original documents as we are unable to return them to you.

Documents in a language other than English must be accompanied by an English translation certified by a translator and:

  • If in Australia, the translator should be accredited by the National Accreditation Authority for Translators and Interpreters (NAATI) or
  • If outside Australia, the translator should be qualified and endorse the translated document with their full name, details of their qualification and contact details.

3. Paying the application fee

You can pay the NSW nomination application fee online for most applications by using a Visa or MasterCard. Application fees are not refundable.

Please make sure you enter your EOI number correctly when entering your payment details.

Once the online payment is successfully made, a receipt will be sent to the email address entered with the payment. Please provide a copy of the receipt with your application.

*Fees vary according to whether you are in Australia or outside Australia when you submit your application. If you are in Australia when you apply, you will need to pay GST. Please ensure you pay the correct fee.

4. Submitting the application

The completed application, together with all relevant supporting documents and evidence of payment of the application fee, can be submitted by email, post or by courier.

If your application includes bulky attachments, you can submit your application form and fee by email and post your supporting evidence separately. If you scan and email your supporting evidence, please ensure that the scanned copies of original documents are either in colour or are certified black and white copies.

5. After you submit your application

After you submit your application and have paid the application fee, you will receive an acknowledgement email from NSW Department of Industry.

Our processing time for 188C SIV applications is 24 hours.

Our processing time for 132 Business Talent applications is five (5) business days for complete applications.

Our current processing time for other business applications is up to eight (8) weeks. Applications accompanied by all required information and documentation will be processed more quickly.

NSW reserves the right to assess the applicant’s genuine and realistic commitment to conduct their proposed business activity in NSW. Processing times will be longer when time is needed to assess this.

If your application is approved, you will receive a notification of approval by email with information about your nomination.

Once you move to NSW, you should keep NSW Department of Industry informed of your contact details by completing the Business Nominee Information Update form.
