There are some cases in which there is no prospect of any future business dealings, and this may be enough of a reason to switch to a more aggressive style of interaction. In this case, you may be relying on the other side having some fear of being sued by you.
However, you should only take this approach if you have identified that fear of being sued is an actual motivator for the other side. In some cases, the other side won’t care. This might be because they are already insolvent or bankrupt, or perhaps that they feel they have nothing to lose. It could also be because they know the difficulties you will face with litigation, and think it unlikely that you will be able to go through with it.
Most of the time, the best way to maximise your cents in the dollar is to maintain and leverage the relationship.
